Our stories are scattered, individualized, invisibilized; they have to often been neglected, particularly for those of us that are also Black and/or racialised. We have little to no collective archives.

We need you, your stories, your memories, to make our lives and knowledge more visible, to collectivize and bind them to each other, to cherish them, to come together, exist, and allow others to do so too.

This is a call for (un)official archives, personal collections, memories, ephemeral documents, etc. to find traces of trans*, non-binary, intersex and gender-nonconforming stories in Belgium.

We are LoupKass, precarious worker of images, photographer and videomaker, non-binary trans ft*. & Nour researcher animator in an anti-racist association, visual art student, non-binary.

We are collecting archives as part of a project launched by MOTHERS & DAUGHTERS in collaboration with Genres Pluriels, for an exhibition + events in May 2022.

Mothers & Daughters, in association with Genres Pluriels, are looking for an individual or collective of individuals that want to dig into archives, personal collections, memories, etc. to find traces of trans*, non-binary, intersex and gender-nonconforming his/her/theirstories in Belgium, and produce an exhibition, publication and public program to share this research in May and June 2022.

The belgian Trans/Inter Psycho-Médico-Social Network

About 5 % of the Belgian (and global) population is transgender and/or intersex.

In order to be able to receive and redirect transgender and/or intersex people towards psycho-medical-social services that are aware and trained in the respectful and therefore non-psychiatrist approach of trans-identities and the non-pathologist approach of intersexuality, Genres Pluriels has created the Psycho-médico-social (PMS) Trans* et Inter* belge network.

According to the European Convention on Human Rights, everyone has the Right to control over their own body (art.8). Is this really reality for all Belgians? As of today transgender and/or intersex people still do not have the freedom to enjoy this right.

Even though the Belgian law established that transgender people are allowed to change their identity card with regards to their name and/or their “registered sex” since 2018 on the basis of self-determination, access to healthcare that is specific for trans-people still has to be improved.

People who experience trouble with their birth-assigned sex and who want to transition by means of hormonal treatments and/or surgery and who have gathered enough facts from competent professionals to make an informed decision, should not have to justify themselves and to submit a required psychiatric follow-up.

An appropriate training for psychological, medical and social professionals would allow to depathologise trans-identity and intersex thematics, which are still too often pathologically connoted, stigmatised and assimilated to mental illness for trans-identities or a physical pathology for intersexuality.

In 2018, the partnership between various professional psycho-medico-social sectors from all over Belgium formed the Psycho-médico-social Trans* et Inter* belge network, which was ratified during a Symposium at CHU Saint-Pierre, followed by another Symposium at AZ Jan Palfijn in 2019.

The Psycho-médico-social Trans* et Inter* belge network's targets:

a respectful, appropriate and depathologising treatment of transgender and intersex people by psychological, medical and social workers that are educated on trans-identities and intersexuality;
a knowledge exchange between those professionals;
a chance for less secure people to receive trans-specific healthcare in low-demand facilities;
a decentralisation of the appropriate healthcare for transgender and intersex people by leaning on general practitioners, medical centres, mental health services, family planning clinics… that are closer to people, so they do not have to move far.

ICD-11 depathologizes Trans and Gender Diverse identities

Organizations from across the world have signed a joint statement and call to action to join with trans* organizations in working together to fully dismantle pathologization.

During the 72nd World Health Assembly (WHA), taking place from 20 – 28 May, the World Health Organization (WHO) officially adopts the International Classification of Diseases – 11th Revision (ICD-11).

In the ICD-11, trans-related categories have been removed from the Chapter on Mental and Behavioral Disorders, which means that trans identities are formally de-psycho-pathologized in the ICD-11.

It has taken a long time to get here. Until a few years ago, removing pathologizing categories affecting trans and gender diverse people from the ICD-10 list of mental disorders seemed impossible. Today, we know that full depathologization can be achieved and will be achieved soon.

The reviewing and updating process for the ICD-11 will soon begin, in which activist efforts will focus on replacing the term ‘gender incongruence' with a non-pathologizing and non-stigmatizing term; removing the category Gender Incongruence of Childhood (GIC); and ensuring access to support systems with health coverage for trans and gender diverse children.

Other areas of focus will be advancing legal depathologization everywhere, to ensure that the human rights of all trans and gender diverse people are respected and progressive expansion of public healthcare coverage, as established in the Universal Health Coverage framework.

Full depathologization of trans and gender diverse people requires the complete removal of: psycho-medical classifications; legal and bioethical gatekeepers; corporate-driven medical care & treatments; normative gender stereotypes; and all forms of socioeconomic injustice.

Although the ICD-11 process appears to have finished, in reality it is just starting. We have everything to gain from engaging in the ongoing review process.

Belgium must respect the fundamental rights of transgender people

In 2014, the Federal Government Agreement stated that "'the Law on Transsexuality of May 10th, 2007' would be adapted in accordance with the international human rights obligations”. Genres Pluriels, together with the country's three lesbian, gay, bisexual, trans* and intersex (LGBTI) umbrella organisations, Arc-en-Ciel Wallonie, Çavaria and the RainbowHouse Brussels, as well as Amnesty International and the Human Rights League, are calling upon the Government and the Parliament to honour without delay this commitment.

The rights of trans* people are at the heart of the 2016 edition of the Pride.be. We are mobilising our organisations in order to clarify and explain in detail our proposals, with the assistance of the Equality Law Clinic of the Free University of Brussels. We acclaim the constructive discussions that were initiated with the Government. We call upon all the political parties to do background work addressing the top four priorities for the respect of the fundamental rights of the persons concerned.

First, it is imperative that the recognition of gender in civil status registers and on any official documents be completely dissociated from any kind of medical and psychiatric history. Trans* people must be given the right to self-determination of their personal identity, including gender identity. This is a necessary precondition for their social integration. It also entails the right to protection of all personal data that could a posteriori reveal one's trans* history.

Second, Belgium must adopt a clear policy on depsychiatrisation and depathologisation of trans* people. While trans* people should have free access to psychological counselling and to the medical treatment of their choice should they choose to modify their primary or secondary sex characteristics, they must not be subject to any obligation in these matters. In particular, access to treatment must in no way be gated behind visas or psychiatric consultations.

Third, it is necessary to guarantee access to freely chosen medical healthcare as well as the rights of the patient, in particular the free choice of one's practitioner. Moreover, access to the chosen healthcare is only effective if reimbursement is guaranteed, regardless of the access conditions and in full transparency. Without these guarantees, the right to the free development of one's gender identity would remain a fiction for many trans* people despite it being recognized by the law.

Fourth, our proposals aim to ensure that medical treatments available for trans* minors are in conformity with the provisions of the international Convention on the Rights of the Child.

The Belgian law that has been in effect since 2007 violates all of these rights and principles. By making medical procedures that include sterilisation a precondition for the rectification of civil status registers, it forces trans* people to choose between mutilation and endless social exclusion. Furthermore, by locking them into a mandatory and rigid treatment pathway, it denies their diversity and their physical and psychological integrity.

Step by step other countries show the way, in Europe (Denmark, Malta) and elsewhere (Argentina has been an example for the rest of the world since 2012). A legal doctrine is being created based on the Yogyakarta Principles, to which the Government Agreement of 2014 makes reference. The pseudo-medical doctrines of the past are being challenged, with the support of the European Union and the Council of Europe.

From 2016 onwards, Belgium has the opportunity to start contributing to this movement, to this global progress, for it involves breaking down gender stereotypes and the compulsory and sometimes arbitrary assignment of people to strictly binary-gendered categories.
